Digital Millennium Copyright Act (DMCA) Policy
As a platform for user-submitted posts, Homes and Hues takes intellectual property rights seriously and require our submitters and readers to do the same. As part of the safe harbor provision of the Digital Millennium Copyright Act (DMCA), we comply with DMCA notifications as part of the procedure for addressing claims of copyright infringement.
DMCA Notice Requirements
If you want to report a claim that a third party is infringing on your copyright, please send a notice to help@pictohq.com. Such DMCA notice must meet the minimum requirements as outlined below:
- 1. A description of the copyrighted work that you claim is being infringed
- 2. A description of the material that you claim is infringing, including URL of the material
- 3. Your name, address and telephone number, physical or electronic signature and title (if you are an agent acting on behalf of the copyright holder)
- 4. Your statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agents or the law
- 5. Your statement that, under the penalty of perjury, you are the owner or are authorized to act on the behalf of the copyright holder
We will review the notice and take appropriate action, which may include removal of the material from our website, disabling or termination of accounts of users who infringe on the copyright of others.
Misrepresentation of infringements may incur civil damage penalties, including costs and attorney fees.
DMCA Counter Notice Requirements
If you received notice that your post was taken down because of a DMCA claim, you may file a counter notification to help@pictohq.com with the following information:
- 1. Your contact information, including name, address, email, telephone number, and electronic or physical signature
- 2. Descriptions of the material which has been removed
- 3. Your statement that, under the penalty of perjury, you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- 4. Your statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is located outside the USA, for any judicial district where the service provider may be found.
- 5. Your statement that you will accept service of process from the party or agent of the party who provided the original DMCA notification.
